  1. General information
    1. This privacy policy (“Policy”) relates to AlixPartners UK LLP and its affiliated companies, which are collectively referred to as “we”, “us” and “our”. This Policy sets out how we use and protect any personal information that you give us when you use the Site. This Policy provides information about how we handle personal data, e.g. what kind of data we collect, how we collect them and how we use them. If you have any questions about this Policy or do not agree to it any of its terms, you should stop using the Site immediately.
    2. We comply with all relevant provisions of the General Data Protection Regulation ((EU) 2016/679) (“GDPR”) and all applicable legislation implementing any provisions of the GDPR as may be enacted from time to time.

  2. The information we collect about you

    1. Electronic Claim Submission
      To the extent authorised by applicable law you might be able to submit an electronic claim on the Site. In connection with the Electronic Claim Submission, you might provide a name, postal address, email address, telephone number, claim and bank account details and other information about you or the claim (such as documents that support the claim are required). We may use this information for any purposes related to the claim administration or insolvency process, including without limitation claim analysis, objections, plan solicitation and voting, notice and other matters.
    2. Contact details
      If you communicate with us through the “Contact Us” link on the Site, we may ask you for information such as your name, email address, postal address and telephone number. We use this information to respond to your request. If you request information that requires the response of a third-party, we may forward your contact information to that third-party to respond.
    3. Information gathered by automated means - cookie policy
      1. We may collect certain information by automated means, such as cookies, when you visit the Site. The information we collect in this manner may include IP address, browser type, operating system, referring URLs, information on actions taken on the Site, and dates and times of Site visits.     1. We gather information required for the purposes of the Electronic Claim Submission. In addition, we may use the information we collect on the Site for the administration of the Site, compliance with our legal obligations, enforcement of our Terms of Use or in other ways for which we provide specific notice at the time of collection.
    2. We do not otherwise disclose your personal information we collect about you on the Site, except as described in this Policy and required by applicable law. We also may share any information with our group companies and service providers who perform services on our behalf. These service providers are not authorised by us to use or disclose the information except as necessary to perform services on our behalf or comply with legal requirements. We require these service providers by contract to appropriately safeguard the privacy and security of personal information they collect, use, disclose or otherwise process on our behalf.
    3. We may disclose information about you (i) if we are required to do so by law or legal process, (ii) to law enforcement authorities or other government officials, or (iii) when we believe disclosure is necessary or appropriate to prevent physical harm or financial loss, or in connection with an investigation of suspected or actual fraudulent or illegal activity. We also reserve the right to transfer personal information we have about you in the event we sell or transfer all or a portion of our business or assets.     4. We will not store your personal information any longer than required for the purpose described in this Policy or as otherwise agreed with you.
  4. How we protect your information
    1. We maintain reasonable administrative, technical and physical safeguards designed to protect the personal information you provide against accidental, unlawful or unauthorised destruction, loss, alteration, access, disclosure or use.
    2. We will use all reasonable efforts to safeguard your personal information submitted via our Site. However, you should be aware that the use of the Internet is not entirely secure and for this reason we cannot guarantee the security or integrity of any personal information which is transferred from you or to you via the Internet.
  5. Overseas transfers
    If you are resident in the European Economic Area (“EEA”) or Switzerland, we comply with applicable legal requirements providing adequate protection for the transfer of your personal information to countries outside of the EEA and Switzerland. We and our U.S. subsidiaries are certified under the EU-U.S. Privacy Shield Framework and the Swiss-U.S. Privacy Shield Framework as set forth by the U. S. Department of Commerce regarding the collection, storage, use, retention, transfer and other processing of personal information transferred from the EEA and Switzerland to the U.S, respectively.   6. Access to your information and updating and correcting your information
    1. You have the right to request a copy of the information that we hold about you. If you would like a copy of some or all of your personal information, please send an email to the email address indicated in clause 8 below.
    2. We want to ensure that your personal information is accurate and up to date. If you would like us to update or correct any inaccuracies in such information please let us know the correct details by sending an email to the email address indicated in clause 8 below. Amending any Claims electronically submitted is governed by applicable legal requirements. Subject to applicable law, we may limit or deny access to personal information where providing such access is unreasonably burdensome or costly under the circumstances.
  7. Changes to Privacy Policy
    We keep the Policy under regular review. If we change the Policy we will post the changes on the Site, so that you may be aware of the personal information we collect and how we use it at all times. You should check this page from time to time to ensure you are aware of any changes.
  8. Links to other websites
    The Site may contain hyperlinks or references to other websites. This Policy applies only to the Site so when you access other websites through hyperlinks or references on the Site you should read their own privacy policies. To the extent any linked websites you visit are not owned or controlled by us, we are not responsible for those websites’ content, any use of any such websites, or the privacy policies/practices which may or may not be placed thereon and hereby exclude all liability for the data protection and data security devices provided on such websites.
  9. Your consent
    1. By submitting your personal information hereon, you consent to our use of that information, including sensitive personal data, if applicable and as defined in the relevant laws, as set out in this Policy and the relevant laws.
    2. Where you submit personal information on behalf of someone else, you should only do so on the basis that you have the consent of that person to the processing of respective personal data, including sensitive personal data, in accordance with this Policy and the relevant laws and to you receiving on such person’s behalf any data protection notices which we may issue. In submitting data to us on behalf of someone else, you are representing to us that any such person has so consented.
 

DATA ACCESS AGREEMENT 

 

  • “In connection with the joint provisional liquidations of Markel CATCo Investment Management Ltd., Markel CATCo Reinsurance Fund Ltd. (Private Fund), CATCo Reinsurance Opportunities Fund Ltd. (Public Fund) and Markel CATCo Re Ltd. (collectively, the Companies), AlixPartners has agreed to disclose Information to investors and creditors (Receiving Parties) in relation to the Schemes of Arrangement of the Public Fund and Private Fund, Joint Provisional Liquidations, and the Chapter 15 Proceedings of the Companies.
  • Information means all information that AlixPartners discloses or makes available to Receiving Parties, including, without limitation, information which is confidential and proprietary to the Companies or otherwise not generally available to the public and which includes among other things, documents, files, reports and other written or electronic information and data relating to the Companies, Schemes of Arrangement, Joint Provisional Liquidations, or the Chapter 15 Proceedings.   
  • AlixPartners nor their advisers has made or makes any representation or warranty to the accuracy or completeness of any Information provided or any other information supplied or as to the reasonableness of any assumptions on which any of the same is based (and there is no obligation on AlixPartners or any of its representatives to update or correct such information) and the Receiving Parties agree, on behalf of itself and its representatives, that neither AlixPartners nor any of its representatives shall have any liability to the Receiving Parties, or to any of its representatives, resulting from the use of the Information or any other information supplied”
